APEXFORGE PCs — TERMS OF SERVICE
OVERVIEW
Welcome to ApexForge PCs. These Terms of Service govern your use of the ApexForge PCs website and your purchase of products from us.
By accessing our website, placing an order, or using our services, you agree to these Terms of Service, our Privacy Policy, Return & Refund Policy, and Shipping Policy.
1. PRODUCTS
ApexForge PCs sells built-to-order desktop computers and related products. We make reasonable efforts to ensure that product descriptions, specifications, images, pricing, and other information displayed on our website are accurate.
Product images may be representative renderings or photographs, and minor visual differences may occur. Component appearance may also vary by manufacturer or model.
Unless otherwise agreed with the customer, the completed system will contain the components and specifications stated in the customer's order.
2. ORDERS
Placing an order constitutes an offer to purchase from ApexForge PCs. We reserve the right to accept, decline, or cancel an order when reasonably necessary, including because of payment problems, suspected fraud, pricing errors, product availability, or other circumstances preventing us from fulfilling the order.
Customers are responsible for reviewing their order and providing accurate contact, billing, and shipping information.
3. 72-HOUR CANCELLATION PERIOD
ApexForge PCs provides a 72-hour cancellation period beginning when an order is placed.
We will not begin assembling the customer's PC during this cancellation period.
A customer may cancel an order during the 72-hour cancellation period for a full refund.
Once the 72-hour cancellation period expires, we may begin ordering components and/or assembling the system. After that point, the order is considered final and cannot normally be cancelled.
4. BUILT-TO-ORDER SYSTEMS & RETURNS
ApexForge PCs systems are built to order. Because systems are assembled specifically for each order, all sales are final after the cancellation period and we do not accept returns or exchanges for change of mind, buyer's remorse, or preference changes.
This does not eliminate any rights or remedies that cannot legally be excluded. Damaged, defective, or incorrect systems will be handled according to our Return & Refund Policy and applicable law.
5. PRICING & PAYMENT
Prices may change without notice. The price charged for an order will generally be the price shown when the order is placed.
Applicable shipping charges and taxes may be added during checkout.
Customers must provide accurate and authorized payment information. Orders may be cancelled if payment cannot be processed or if a transaction is reasonably suspected of being fraudulent or unauthorized.
If an obvious pricing, specification, or listing error occurs, ApexForge PCs reserves the right to correct the error and, where appropriate, cancel and refund an affected order.
6. BUILD TIME
After the 72-hour cancellation period, ApexForge PCs generally requires approximately 5–10 business days to assemble, configure, test, and prepare a PC for shipment.
Build times are estimates rather than guaranteed completion dates. Component availability, order volume, holidays, or other circumstances may cause delays.
If a significant delay affects an order, we will make reasonable efforts to contact the customer.
7. TESTING & DOCUMENTATION
Every ApexForge PC is assembled, configured, and tested before shipment.
ApexForge PCs may document the completed system using photographs, video, system information, component serial numbers, benchmark or testing results, and other records demonstrating the system's configuration, condition, and operation before shipment.
This documentation may be retained to assist with quality control, warranty support, shipping claims, fraud prevention, and order disputes.
8. SHIPPING
ApexForge PCs currently ships to eligible addresses within the United States.
Shipping transit times shown at checkout begin after the PC has completed assembly and testing and has been transferred to the shipping carrier.
Delivery dates are estimates and may be affected by carrier delays, weather, holidays, or circumstances outside our reasonable control.
Customers are responsible for providing a complete and accurate delivery address.
9. LOST OR DAMAGED SHIPMENTS
ApexForge PCs ships systems using insured shipping services where stated.
If a shipment is lost or arrives damaged, the customer should contact ApexForge PCs promptly. Customers should retain the computer, shipping box, packing materials, shipping label, and other relevant materials and provide photographs or other documentation when reasonably requested.
ApexForge PCs will work with the applicable carrier and/or shipping insurance provider to investigate qualifying lost or damaged shipments and file a claim when appropriate.
Depending on the circumstances and applicable coverage, an appropriate resolution may include repair, replacement, replacement components, or refund.
Customers should not return a damaged computer without authorization from ApexForge PCs.
10. WARRANTIES & SUPPORT
ApexForge PCs will provide any warranty expressly stated on the applicable product page or warranty policy.
Individual computer components may also include manufacturer warranties. Manufacturer warranty coverage is governed by the applicable manufacturer's terms.
Warranty coverage does not necessarily cover damage caused by accidents, misuse, unauthorized modifications, improper installation of replacement components, liquid damage, electrical damage caused by external equipment, or other damage unrelated to a defect in the system or our workmanship.
Nothing in these Terms limits warranty or consumer rights that cannot legally be excluded.
11. CUSTOMER MODIFICATIONS
Customers may upgrade or modify their computers after purchase. However, ApexForge PCs is not responsible for damage caused by an improperly installed component, modification, overclock, software modification, or other customer or third-party action.
Modifying a system does not by itself eliminate rights relating to unrelated qualifying defects where prohibited by applicable law.
12. DATA
Customers are responsible for maintaining backups of important files and data stored on their computer.
Troubleshooting, repair, replacement, operating-system reinstallation, storage-device failure, or other service may result in data loss. To the extent permitted by law, ApexForge PCs is not responsible for customer data that was not properly backed up.
13. WEBSITE & INTELLECTUAL PROPERTY
The ApexForge PCs name, branding, website design, original graphics, photographs, videos, written content, and other original materials are owned by ApexForge PCs or used with permission from their respective owners.
Content from our website may not be copied, reproduced, republished, or commercially exploited without authorization except where permitted by law.
Third-party company names, trademarks, product names, and logos remain the property of their respective owners.
14. PROHIBITED USE
You may not use our website or services for unlawful purposes, fraud, unauthorized transactions, malicious activity, interference with the operation or security of the website, infringement of intellectual-property rights, or other activity prohibited by applicable law.
We reserve the right to restrict access or cancel orders associated with suspected fraud, abuse, or unlawful activity where permitted by law.
15. ERRORS & AVAILABILITY
Occasionally our website may contain errors involving pricing, specifications, descriptions, availability, shipping information, or other content.
ApexForge PCs reserves the right to correct such errors and update information. If an error materially affects an order that we cannot fulfill as advertised, we may contact the customer with available options or cancel the affected order and issue an appropriate refund.
16. THIRD-PARTY SERVICES
Our website may use services, payment processors, shipping providers, applications, links, or other functionality operated by third parties.
Use of third-party services may also be subject to the terms and policies of those providers.
17. RELATIONSHIP WITH SHOPIFY
ApexForge PCs is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with ApexForge PCs. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and ApexForge PCs, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with ApexForge PCs.
18. PRIVACY
Personal information collected through our website is handled according to our Privacy Policy and applicable privacy laws. Shopify and other service providers may also process information necessary to operate the store, process payments, fulfill orders, prevent fraud, and provide related services.
19. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, ApexForge PCs will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of our website or products, including lost profits or loss of data, except where such liability cannot legally be limited or excluded.
Nothing in these Terms excludes or limits liability or customer rights that cannot legally be excluded or limited.
20. CHANGES TO THESE TERMS
ApexForge PCs may update these Terms of Service from time to time. The current version will be posted on our website.
Changes will apply as permitted by applicable law and will not retroactively remove rights that already apply to an existing order.
21. GOVERNING LAW
These Terms are governed by applicable United States law and the laws of the state in which ApexForge PCs is legally established, except where applicable law requires otherwise.
